In short

1. Who we are

Remembrance (remembrance.myfrontpage.website, and each page at its own name.myfrontpage.website address) is provided by Hattech Limited ("we", "us"). Payments are made to Hattech Limited and processed by Stripe. You can contact us at chris@hattech.co.nz, about payments and billing at accounts@hattech.co.nz, and about privacy, complaints or content at abuse@hattech.co.nz. You must be 16 or over to make a page or join one; younger family members can take part with a parent or guardian.

2. What's free, and what we charge for

Creating a tribute is free: the story builder, voice and writing help, the timeline and map, the movie, slides, the keepsake designs and downloads. These tools and services are provided at no charge.

When you put a page online, it's free for 30 days from the day it goes live, with every feature included. After that, keeping it online costs a one-off $20 (NZD) per page — or $5 (NZD) for an animal's page, which holds up to 20 photos and doesn't include saving the movie as a video file — each tribute site is charged on its own. This charge is for hosting and storage — the servers, storage and bandwidth that keep the page, its tribute wall, memories and photos online and available to the people you share it with. It is not a fee for the tools or services above.

Prices are set in New Zealand dollars and include GST for New Zealand customers. If you're paying from another country, the payment page shows the price in your own currency (worked out from the NZD price at that day's exchange rate, rounded), and that is the amount you're charged. There's no subscription and nothing renews automatically.

3. The 30 free days, reminders and deletion

Only the person who made the page sees the countdown. If a page isn't kept:

Please download anything you want to keep before then. Reminders go to the email address on the account, so keep it up to date.

4. "Kept for good"

Once paid, we keep the page online for as long as we operate Remembrance, with no further charge. If we ever have to close the service, we'll give owners at least 90 days' notice by email and a way to download their page's photos, stories and memories.

5. Payment and refunds

Payment is taken once, by card, Apple Pay or Google Pay through Stripe, and you get a GST tax invoice by email; we don't see or store your card details. If something goes wrong with your page, or you change your mind within 14 days of paying, contact us and we'll put it right or refund you. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

6. Owners, and deleting a page or your account

The person who makes a page is its main owner. They can add up to 4 more family members as owners (5 in all), who can help manage the page: sharing it, choosing who can see and post, looking after the tribute wall and paying to keep it online. The main owner can remove owners, hand the page over to another owner (who then becomes the main owner and receives the reminders), and delete the page. Any owner can stop being an owner.

The main owner can delete a page at any time, and anyone can delete their account from Account in My tributes. Deleting removes the page, its memories and photos for good. When an account is deleted, pages it owns alone are deleted; pages shared with other owners are handed to the next owner rather than deleted. Deleting a page doesn't entitle you to a refund outside the 14 days in section 5. We keep a record of payments (amount, date and page) as the law requires, without your email address.

7. Your content

You own the photos, words, recordings and videos you add, and so do the family and friends who add memories. You give us permission to store them, make the smaller copies, slideshows and movies the page uses, and show them to the people the page is shared with — only to run Remembrance. This ends when the content or page is deleted.

When you add something you confirm that:

The page's owner decides who can see it (from public to only the people they share it with) and who can post. Memories marked private are seen only by the owners and the close family they choose; authors can edit or remove their own. Owners can remove any memory on their page and block anyone. We may remove anything that breaks these terms or the law.

Copyright: if something on a page is your copyright and was added without permission, tell us (⚑ Report, or abuse@hattech.co.nz) with the page address and what it is, and we'll take it down.

8. Reports and complaints

Anyone can report a memory or a page with ⚑ Report, or by emailing abuse@hattech.co.nz. Reports come straight to us, and we also tell the page's owners about reported memories so they can act. For a complaint that content is harmful under the Harmful Digital Communications Act 2015, we follow the Act's process: within 48 hours we either remove the content or pass the complaint on to the person who posted it; if they agree, or don't reply within 48 hours, we remove it; if they object, we let you know, and it can stay up while you consider other options (such as Netsafe). We'll never tell the person who posted it who complained without your agreement. We may also take a page offline while a serious complaint is looked into. If you're a relative and want a page about your family member changed or taken down, tell us the same way.

9. Privacy

We collect only what's needed to run the service: your email address and name, the content you add, and basic technical information. We use your email to sign you in and to send messages about your pages (such as the reminders above). We don't sell personal information. Private pages are not listed in search engines. You can ask us for a copy of your information, or to correct or delete it, under the Privacy Act 2020. Our Privacy Policy explains what we collect, the services we use, how long we keep it, and your rights.

10. Using Remembrance fairly

Don't use the service to harass anyone, to post unlawful content, or to try to get around how pages are shared. We may suspend a page that does.

11. Changes and the law

We may update these terms; if a change affects pages you've paid for, we'll email you first. These terms are governed by the laws of New Zealand.
